AX3sonic.com provides hosting, streaming, subscription, and monetization tools for corporate and private podcasts, including internal company communications, branded audio content, and exclusive private podcast networks.

3. Account Registration

  • You must provide accurate and complete information.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • Accounts registered by bots or automated methods are prohibited.

4. Eligibility

  • Users must be at least 18 years old or the age of majority in their jurisdiction.
  • Accounts may not be shared without authorization.
  • Corporate clients may assign multiple user roles under a master account.

5. Privacy and Data Use

Your use of AX3sonic.com is subject to the Privacy Policy included within this document, which explains how we collect, use, and protect your data.

  • You retain ownership of your content.
  • You are responsible for the accuracy and legality of your content.
  • You must have the necessary rights to use and distribute your content.
  • You must not use the Platform to distribute or host illegal or harmful content.

Enterprise clients may request a Data Processing Agreement (DPA) to meet regulatory compliance needs (e.g., GDPR or HIPAA if applicable).

6. Content Ownership & Rights

For Podcasters:

  • You retain ownership of the content you upload.
  • By using AX3sonic.com, you grant us a limited, royalty-free license to host and distribute your content within the scope of the services provided.

For Listeners:

  • You are granted a personal, non-transferable license to access subscribed or public podcast content.

7. Payment and Subscriptions

  • Payment processing is handled by third parties (e.g., Stripe).
  • You are responsible for all applicable subscription fees.
  • Fees are non-refundable except as required by law or explicitly stated.

8. Content Restrictions

You may not upload, distribute, or promote content that:

  • Violates copyright, trademark, or other IP rights.
  • Is unlawful, harassing, discriminatory, or harmful.
  • Contains malware, phishing links, or deceptive information.

We reserve the right to remove such content and suspend or terminate offending accounts without notice.

9. Acceptable Use

You agree not to:

  • Circumvent access controls or security features.
  • Harvest user information or engage in scraping.
  • Disrupt or overload the system (e.g., via DDoS attacks).
  • Use the Platform for spamming, abusive, or illegal purposes.

10. Termination

You may delete your account at any time. We reserve the right to:

  • Suspend or terminate accounts for violation of these Terms.
  • Withhold access to content and services for unpaid accounts.

11. Disclaimer of Warranties

AX3sonic.com is provided "as is" and "as available." We make no warranties, expressed or implied, including:

  • That the service will be error-free or uninterrupted.
  • That content will meet your expectations or business goals.

12. Limitation of Liability

To the maximum extent permitted by law, AX3Sonic shall not be liable for:

  • Indirect or consequential damages.
  • Loss of revenue, data, or profits.
  • Any content posted by users or third parties.

Our total liability shall not exceed the amount paid by you in the 12 months prior to the claim.

13. DMCA and Copyright Policy

If you believe content on AX3sonic.com infringes your copyright, please send a DMCA notice to sonichelp@ax3sonic.com with:

  • Your contact info and signature.
  • Identification of the infringing content.
  • A statement of good faith and accuracy.

14. Governing Law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict of laws principles. Disputes shall be resolved in the state or federal courts located in New Jersey.

15. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after updates constitutes your acceptance of the revised Terms.

16. Governing Law and Arbitration

These Terms are governed by the laws of the State of New Jersey, specifically Warren County, without regard to its conflict of laws principles. Any legal disputes arising under or in connection with these Terms shall be resolved exclusively through binding arbitration conducted in Warren County, New Jersey. By using this platform, you waive any right to a jury trial or to participate in a class action lawsuit.

17. Indemnification

You agree to indemnify, defend, and hold harmless AX3Sonic, its officers, directors, employees, contractors, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of AX3sonic.com, your violation of these Terms, or your infringement of any third-party rights.
